This Coaching Agreement is between TruFitness4Life, operated by Truman Barrett (the “Coach”), and the person purchasing coaching (the “Client”). It becomes effective when the Client accepts it during checkout or otherwise agrees to it in writing.
1. Coaching term and scope
The program lasts 12 consecutive weeks beginning on the agreed start date. It includes onboarding and goal review, personalized home or gym programming, weekly check-ins and program adjustments, technique feedback, coaching support, progress reviews around weeks 4, 8, and 12, and a practical plan for returning after a disrupted week.
Coaching is delivered remotely unless both parties agree otherwise. The Coach may adjust exercise selection, training load, or schedule based on the Client’s feedback, available equipment, progress, and safety needs.
2. Fees and payment schedule
The total program fee is $897, paid as three monthly installments of $299. The first installment is due at enrollment. The second and third installments are charged approximately one month apart on the billing date shown by the payment provider.
The payment plan covers one fixed 12-week coaching term. It does not renew into an ongoing membership or a fourth payment without the Client’s separate written agreement. Failed or overdue payments may pause coaching access until the account is current.
3. Cancellation, refunds, and pauses
A Client who cancels before individualized onboarding or programming begins will receive a refund of payments made, except where nonrefundable processing costs are permitted by law. After individualized service begins, payments covering a service period that has already started are nonrefundable except where required by law.
Because a coaching spot is reserved for the full term, the remaining scheduled installments stay due if the Client chooses to stop early. The Coach may approve a written pause, transfer, or release from future installments for a significant medical event or exceptional hardship. Any approved change must be documented in writing.
If the Coach ends the agreement without Client breach, the Coach will refund any prepaid amount for coaching that will not be provided. These terms do not limit any non-waivable rights available under applicable law.
4. Scheduling and communication
The Client agrees to complete check-ins honestly and on time and to communicate schedule changes as early as reasonably possible. Missed check-ins, unused feedback opportunities, or workouts the Client chooses not to complete do not create a refund or extend the term unless the Coach agrees in writing.
Coaching messages are not monitored continuously and are not an emergency service. For urgent or emergency concerns, contact appropriate local emergency or healthcare services.
5. Client responsibilities
The Client agrees to provide accurate information about training history, current symptoms, injuries, medications or restrictions relevant to exercise, equipment, and readiness. The Client is responsible for using appropriate equipment and surroundings, following instructions, asking questions when uncertain, and choosing loads and movements that can be performed safely.
The Client remains responsible for deciding whether to participate in a workout and for obtaining medical clearance when appropriate. The Client agrees not to share access, programs, or private coaching materials with another person.
6. Fitness scope and medical boundaries
TruFitness4Life provides general fitness, strength, conditioning, mobility, habit, and performance coaching. It does not provide medical care, physical therapy, diagnosis, treatment, mental health care, or individualized medical nutrition therapy. Coaching does not replace advice from a qualified healthcare professional and will not override a clinician’s instructions.
The Client should stop exercise and seek qualified care for severe, sudden, sharp, or worsening symptoms, chest pain, fainting, severe shortness of breath, new numbness or weakness, significant swelling, suspected fracture, severe heat illness, or other concerning symptoms.
7. Assumption of exercise risk
Physical training has inherent risks, including soreness, strains, falls, equipment failure, aggravation of an existing condition, and more serious injury. By participating voluntarily, the Client acknowledges these risks and accepts responsibility for following safety guidance, reporting symptoms, and working within their abilities.
To the fullest extent permitted by law, the Client releases TruFitness4Life and the Coach from claims arising from the ordinary and inherent risks of voluntary participation. Nothing in this agreement releases liability that cannot legally be waived, including liability for gross negligence or intentional misconduct.
8. Results
The Coach will provide the agreed coaching services with reasonable care, but does not guarantee a particular strength, body-composition, weight, performance, health, or competition result. Outcomes vary based on consistency, starting point, health, recovery, nutrition, stress, environment, and other factors outside the Coach’s control.
9. Privacy and sensitive information
Client information is handled according to the Privacy Policy. The Client agrees to share only information reasonably needed for coaching. Payment-card information is processed by the payment provider and should never be sent through coaching messages or stored in the TruFitness4Life dashboard.
10. Photos, videos, and testimonials
Technique videos may be used privately to provide coaching feedback. TruFitness4Life will not publicly use the Client’s name, image, story, results, or testimonial without separate, specific permission. Declining publicity consent does not affect coaching eligibility or service.
11. Coaching materials
Programs, written guidance, videos, templates, and other original coaching materials remain the property of TruFitness4Life. The Client receives a limited, personal, noncommercial right to use them during and after the program. They may not be resold, republished, or distributed without written permission.
12. Ending the coaching relationship
The Coach may pause or end coaching for nonpayment, unsafe conduct, repeated failure to disclose relevant safety information, harassment, abusive behavior, or requests outside the lawful scope of fitness coaching. The Client remains responsible for amounts already earned or due under the cancellation terms above.
13. Entire agreement and changes
This document, the agreed offer, and the Privacy Policy form the complete agreement for this program. A change to price, term, or scope must be agreed to in writing by both parties. If one provision is unenforceable, the remaining provisions continue to apply.
14. Electronic acceptance
Checking the agreement box during checkout and completing payment serves as the Client’s electronic acceptance. The Client should keep the checkout receipt and a copy of this agreement for their records.
